These Terms and Conditions are a binding legal agreement between ATOM Myanmar Limited, a company constituted under the laws of Myanmar with registration number 184676966 and having its registered office at No. 221, Sule Pagoda Road, Level 17,22,23, Kyauktada Township, Yangon (referred to as ATOM) and you (referred to as You or Customer). By using or paying for ATOM broadband internet service you are representing that you are over 18 years of age and that you have read and understood these Terms and Conditions.
Period of Agreement
(၁) This Agreement shall take effect from the Activation date of the Service and shall continue to be in force until terminated in accordance with these Terms and Conditions. For avoidance of doubt, the Activation date of the Service by default is also deemed to be the same as the registration date. Pursuant to this clause, the Customer can request for termination at ATOM Business Call Centerices provided by (Entity of ATOM) that allow you to use or access the Internet.
Provision of the Service
(၁) You shall receive any updated information about the service from ATOM Broadband Website.
(၂) The service is only available in selected coverage areas with LTE/4G network.
(၃) Before buying, you must check whether your location (where you want to use the service) within the coverage area or not and must register via broadband.atom.com.mm website.
(၄) For registration purpose, you are required to provide personal information including contact number, e-mail address and service address to ensure the quality of connection.
(၅) Service address provided in website must be the same with your actual used location.
(၆) Upon successful registration of the Service, you shall receive the following:
One (1) unit of ATOM Home Wireless router
One (1) unit of 4G Data SIM card (inserted in the router)

(၇) You may request for:
Relocation of the Service address through broadband.atom.com.mm website subject to the availability of the Services at the new location.

(၁) Usage
The maximum number of devices can connect to wifi network is 5
(၂) Warranty
The warranty period for the device is one (1) year from the date of purchase.
The following defects are covered in warranty
Indicators are not working (power, network status, Wi-Fi, LAN/WAN, Signal Strength)
Power adapter is not working
Buttons failure
Network port is not working
This warranty does not cover any of below:
Router have been subjected to misuse, accidental, shipping or other physical damage ,improper installation, abnormal operation or handling, neglect, inundation, fire, water or other liquid intrusion;
Router has been damaged due to repair, alteration, or modification by anyone not authorized by ATOM.
That have defects or problems caused by use with non-ATOM branded products or accessories
Warranty/quality sticker or product serial number has been removed, altered or defaced
Without valid proof of purchase
Incomplete information was provided to the ATOM Broad band's authorized service/repair center.
(၃) ATOM Broadband does not provide refunds under the limited warranty in any conditions. ATOM Broadband will replace defective units with new products. Product warranty periods do not renew with replacement units. The original purchase date and warranty period will apply to replacement products.
Customer Responsibility
(၁) You are responsible for making sure that equipment is used safely and properly including but not limited to:
Keeping the equipment secure on your property and insuring such equipment against loss, theft or damage;
Following all instructions we provided by TML and any manufacturer's instructions;
Not providing CPE / device credentials (such as IMEI and Serial Number) to any unauthorized persons. CPE credentials - such as, but not limited to IMEI or Serial Number will be considered as proof of ownership of account.
(၂) You are also responsible for the procedures with respect to use of and access to the Service Location.
(၃) If you change any account details (phone number, service location) provided to ATOM, you have the responsibility to perform any after-sales process such as relocation and updating of account information through instructions provided by TML (i.e. website etc.)
Fair Usage Policy
(၁) The Fair Usage Policy is applied to ensure that an optimum internet experience is available to the maximum number of users. The policy helps prevent network abuse by setting reasonable usage limits, thereby ensuring that the overall service quality for all customers remains acceptable.
(၂) The Fair Usage Policy will apply to your ATOM Home Wireless Internet usage of 150 GB within a 30-day period.
(၃) After exceeding the 150 GB usage limit within the 30-day period:
Your internet speed will be reduced to 0.5 Mbps.
You may continue to use Unlimited Data at the reduced speed for the remainder of the 30-day period.
(၄) The normal internet speed of up to 10 Mbps (maximum speed may vary depending on the service location) will be restored at midnight on the last day of the 30-day period. A new 150 GB quota will then begin for the next 30-day cycle.
(၅) Any remaining data quota from the current 30-day period cannot be carried forward to the next 30-day period.
(၆) Sending or receiving files involving very large amounts of data, including but not limited to traffic generated by peer-to-peer (P2P) software or applications such as BitTorrent or other file-sharing services, may cause network congestion and negatively impact the internet experience of other customers. Therefore, the Fair Usage Policy will also apply to P2P data usage.
(၇) The Fair Usage Policy will not be applied to add-on data packages.
Compliance with Myanmar Laws and ATOM Policy
(၁) You shall observe the laws of Myanmar and shall not use the Service for any unlawful or illegal purposes. In addition to any breach of Myanmar laws, you agree that you shall not use the Service for any of the following:
Sending, receiving, publishing, posting, distributing, disseminating, encouraging the receipt of, uploading, downloading, or using any material that is offensive, abusive, defamatory, indecent, obscene, unlawful, harassing, menacing, or in breach of copyright, trademark, intellectual property, confidentiality, privacy, or any other rights of any person;
Using the Service for commercial purposes unless you are subscribed to office or corporate packages;
Using the Service for non-standard commercial purposes under corporate packages;
Sending or uploading unsolicited emails, SMS, or messages, advertising or promotional materials, offering to sell goods or services, or conducting or forwarding surveys, contests, or chain letters;
Knowingly or negligently transmitting or uploading any electronic material, SMS, or messages (including, without limitation, files containing viruses, corrupted files, or similar software or programs) that are known or likely to cause interruption, damage, destruction, or limitation to the functionality of any computer software, hardware, or telecommunications equipment owned by ATOM or any other internet user;
Allowing activities that invade another person’s privacy, or cause annoyance, inconvenience, or unnecessary anxiety to any person;
Allowing activities that breach any third-party rights, including downloading, installing, or distributing pirated software or improperly licensed software, removing author attributions, legal notices, proprietary labels, or falsifying the origin or source of any software or material;
Allowing any activity that may disrupt or interfere with the ATOM network or services, or cause a host or network to crash;
Launching denial-of-service (DoS), mail-bombing, spamming, or flooding attacks against any host or network;
Making excessive use of the network or placing abnormal burdens on it, including sending or receiving unusually large volumes of emails, SMS, messages, or excessively large attachments;
Circumventing user authentication or security processes of any host or network;
Creating, transmitting, storing, or publishing any virus, Trojan, corrupted program, or corrupted data.
(၂) In addition, you shall not:
Run port scanning software on any ATOM network;
Attempt to gain unauthorized access to any computer system;
Undertake any activity that has an adverse effect on ATOM.
(၃) ATOM shall fully comply with Myanmar laws, regulations, and licensing requirements under the Telecommunication Law 2013, including any applicable standards established by the Regulator relating to service quality.
Service Speed and Availability
(၁) The Service speed and bandwidth will be based on the Service plan to which you subscribe. The maximum speed you receive will depend on various factors, including but not limited to whether the connection is made via cable or Wi-Fi, the materials used in the construction of your premises, and the number of users sharing your specific connection.
(၂) In addition, the speed you experience at any given time may vary and may be lower than the maximum speed of your Service plan. This may depend on factors such as the composition of the data or files being accessed, overall internet traffic, usage patterns, the server you are connected to, and the networks used by you and other users at the same time.
(၃) Based on the above conditions, ATOM does not provide any express or implied promise or warranty that you will be able to download or upload data at any specific speed.
(၄) If you are not satisfied with the Service speed, you may contact ATOM Broadband Customer Service at 09780008080 for assistance.
Suspension, Disconnection or Termination
(၁) ATOM reserves the right to suspend, disconnect, or terminate the Service, either temporarily or permanently, under the following circumstances:
ATOM, in its sole discretion, determines that you use mobile equipment, computers, or Services in a manner not permitted under these Terms and Conditions;
ATOM, in its sole discretion, determines that the user ID or password used to access the Services has been obtained through unauthorized, illegal, improper, or fraudulent means;
You fail to comply with, or materially breach, these Terms and Conditions;
ATOM, in its sole discretion, determines that payment of Service fees is made using a stolen, barred, false, or otherwise invalid debit or credit card, or if such transaction is subsequently charged back;
ATOM is informed that your router has been damaged, lost, or stolen;
You perform, or allow to be performed, any act which ATOM believes may damage, disrupt, or adversely affect the operation or security of the Service;
You become bankrupt, enter into arrangements with your creditors, go into liquidation, have an administration order made, or have a receiver appointed over any of your assets;
ATOM is permanently unable to provide the Service to you;
The law, authorities, or emergency services do not permit ATOM to provide the Service to you.
(၂) In a case where suspension or termination is due, in the sole opinion of ATOM, to Your fault, then You shall lose any existing credit in Your account. However, where, in the sole opinion of ATOM, any suspension or termination is not due to any fault on Your part, ATOM shall use reasonable endeavours to reconnect You to the Service when possible and make available to You any previous credit held in Your account at the time of the suspension or termination.
(၃) You may terminate the Service by giving notice to the ATOM Center 15 days prior to the date of termination of the Service or before the end of month. In case of prepaid top up credit, the service will be terminated after all of your top up credit in your account has been used.
(၄) You also have the right to terminate the Service if ATOM cannot fulfil the Service quality which is committed. Following, if you terminated under this paragraph, ATOM will refund on the credit amount in your account which you have not used.
Indemnity
(၁) You shall fully indemnify, hold harmless and defend ATOM and its directors, officers, employees, subcontractors, agents, stockholders and affiliates from and against all claims, demands, actions, suits, damages, liabilities, losses, settlements, judgments, costs and expenses (including but not limited to reasonable attorney’s fees and costs) ("Claims"), whether or not involving a third party claim, which arise out of or relate to any breach by You of any of these Terms and Conditions or under applicable law, whether or not caused by the negligence of ATOM and whether or not the relevant Claim has merit.
Personal Information
(၁) We may transfer your personal information that you have provided in the CAF to countries outside Myanmar so it can be processed in a secure cloud service. When we process personal information internationally, we take appropriate steps to ensure that your personal information is adequately protected. Typically, such steps include carrying out data security reviews of any services and putting in place contracts with any third party. All data processing of personal information will be handled according to Myanmar laws and internationally accepted best practices.
(၂) ATOM and any affiliate of ATOM has the right to use the information You supply to ATOM for the following purposes which you hereby provide your explicit and informed consent to:
Managing Your account, carry out customer care activities and train our staff, including monitoring calls, emails or text messages that You send us;
Monitoring the quality and security of the network and test and maintain our IT systems;
Analysing Your use of the Services for marketing purposes, including, but not limited to Your browsing history and use of our website.
Such other use as follows from the ATOM privacy notice as published on ATOM Global Privacy Notice.
Miscellaneous
(၁) ATOM has the right to transfer this agreement to any third party at any time. You also have the right to transfer this agreement with the written approval of ATOM.
Complaints/Settlement of Disputes
(၁) If You have any complaints, please contact ATOM at the ATOM Business Call Center Number: +959780008080.
(၂) In case of any dispute between ATOM and You, it should be settled amicably. If the dispute does not settle amicably, it will be reach to the Court.
